Remember receiving notice after notice in the mail about the Bar/Bri class action settlement, which (or was that just us) you kind of ignored? Frankly it didn't look worth filling out.

So while our check is definitely not going to be in the mail, apparently the check for plaintiffs' counsel McGwire Woods hasn't made it to them, either.

 

The National Law Journal: Plaintiffs lawyers who obtained a $49 million settlement in an antitrust class action against the parent company of BAR/BRI are gearing up for another fight before the 9th U.S. Circuit Court of Appeals -- this time, involving their attorney fees.

Class counsel McGuire Woods, which settled the litigation in 2007, filed a notice of appeal on March 8 after U.S. District Judge Manuel Real of the Central District of California eliminated all the firm's attorney fees over an apparent conflict of interest. Two other firms serving as class counsel, New York's Zwerling, Schachter & Zwerling and Washington's Finkelstein Thompson, whose fees the judge reduced, filed a separate appeal on March 15.

The suit involved 300,000 Bar/Bri takers who alleged they paid, on average, $1,000 more than they should have because West, Bar/Bri's parent company, conspired with Kaplan to monopolize the market. The settlement amount was pegged at $49,000,000.

At issue with McGuire Woods is whether or not they properly informed class members about incentive awards five class representatives were awarded in the settlement. Woods has been granted payment for their expenses in the case, which totaled $1.2 million.

This means, the NLJ noted, that the case could be heading for its second trip to the 9th Circuit. The appeals court previously remanded the case to California Central District Judge Manuel Real to address the attorney fee issue following its decision that, "both sides of the case had created a 'disturbing appearance of impropriety' because of the incentive awards that "tied the promised request to the ultimate recovery and in so doing, put class counsel and the contracting class representatives into a conflict position from day one.'"

Seven on Seven - Rhizome (Thanks, Fred!)

When Plancast launched last November, it immediately put other sites like Upcoming, Dopplr, and every single e-vite service on notice. The "Foursquare for the future" has a simplicity that leads to a lot of social activity as we've seen over the past few months. And now that vision will get to flourish further with some seed funding. The $800,000 seed round (which technically went to Plancast parent Worldly Developments) features an impressive investor list: SoftTechVC, True Ventures, Founders Fund Angel, and Zelkova Ventures. As well as individual angels, Aydin Senkut, Saul Klein, David Cohen, Joshua Schachter, Dave McClure, Dan Martell, Ron Bouganim, and Paige Craig. With the round, SoftTechVC's Jeff Clavier also accepts a seat on Plancast's board.

The Washington Post reports that President Obama's advisers are nearing a recommendation that Khalid Sheik Mohammed et al. be prosecuted in a military tribunal rather than federal court in New York City. But this outcome would be accompanied by some kind of agreement with Lindsey Graham to help the administration secure congressional funding and legal authority to close Gitmo in favor of a facility within the United States.

I hesitate to criticize the outcome sight unseen, but Graham is apparently the key actor in negotiating an agreement with the Obama administration on closing the Guantanamo detention facility. I understood Graham to say as much in a recent interview with Greta Van Susteren on her Fox News show in which he asserted the desirability of closing Gitmo.

Closing Gitmo and bringing the detainees to the United States is a bad idea in itself. Closing Gitmo would also be an unacceptable price to pay for saving Barack Obama and Eric Holder from the folly of their unworkable plan to bring KSM to the United States and cloak them in the mantle of the United States Constitution.

Activision tells analysts a third title in development other than Treyarch's 2010 game and ex-EA devs' rumored third-person title; three COD games "possible" next year, including Asian MMOG.

Yesterday, Activision announced that it was launching an entire business unit dedicated to expanding the Call of Duty brand to new genres and business models. The news came one day after the CEO and president of the studio that created Call of Duty, Infinity Ward, appeared to have been fired and their former shop marginalized from the series. Activision now lists the Encino, California, developer as working only on the two downloadable expansions to Call of Duty: Modern Warfare 2, due out later this year.

In its statement yesterday, Activision confirmed that COD: World at War studio Treyarch was working on this year's installment in the series. It also made the following statement:

"The company is also for the first time announcing that a new game in the Call of Duty series is expected to be released in 2011 and that Sledgehammer Games, a newly formed, wholly owned studio, is in development on a Call of Duty game that will extend the franchise into the action-adventure genre."

With Activision offering no further clarification to the press, many game-news outlets took the comment to mean that Sledgehammer Games was developing a possible third-person spin-off of the series for a 2011 release. The company, however, was much more forthcoming with Wall Street analysts, several of whom clarified in notes this morning that there are now at least three full-fledged Call of Duty titles in the pipeline.

"Activision also confirmed that a new Call of Duty title was in the works for 2011 (but notably did not attach Infinity Ward's name to it), and announced a new Call of Duty title in the action/adventure game to be designed by a newly formed studio, Sledgehammer Games, but would not confirm a 2011 release date for this new action title," said BroadPoint AmTech's Ben Schachter.

After also confirming a third COD, Signal Hill Capital Group's Todd Greenwald went even further. He thinks that Activision's massively multiplayer Call of Duty licensing negotiations could result in an Asian-produced title "featuring an entirely new business model driven by high-margin digital, online content and/or subscription fees." He believes that it's "possible" such a game could arrive as early as 2011, given enough development resources.

Today marks the beginning of the Jewish holiday Purim (observing Jews will have started celebrating last night at sundown). This joyous festival marks the deliverance of the Jewish people of ancient Persia from a plot to annihilate them, as recorded in the Bible in the Book of Esther.

Esther was the Queen of Persia. Her cousin (or uncle), a Jew, informed her of a plot to massacre the Jews. He asked Esther to implore her husband, the King, to save the Jews. Esther decided instead to reveal her Jewish identity and ask that King save her and her people. The King complied and hanged his chief adviser, who had planned the massacre. Jews then rose up and killed other Persians who had intended to murder them.

As I understand it, the Book of Esther is one of only two books in the Hebrew Bible that does not mention God. It is the straightforward story of how Jews were threatened with genocide but were able to turn the tables and kill those who would kill them.

The Jews prevailed because of the shrewd and courageous actions of Esther, who risked her life to save the lives of her people. No wonder Esther has been lionized by Jews for ages.

As Abby Wisse Schachter reports in the February issue of Commentary, however, Esther's status may not survive the age of modern feminism. For Jewish feminists, or at least the professionals among them, Esther's shortcomings are manifold. For one thing, she is too nationalistic. Thus, although some feminists make note of her bravery, they are troubled that she used it only to make the world better a better place for Jews. And the fact that her actions led to the killing of those who were out to kill the Jews is seen as especially problematic.

But the heart of the problem is that Esther, in effect, slept with the enemy - that symbol of male domination, the King. And it is here that the Jewish feminists have pulled off a tour de force of literary criticism that leaves me wondering whether to laugh or cry.

According to Schachter, the feminists have found a new hero in the Book of Esther. She is Queen Vashti, Esther's predecessor. Vashti appears only briefly, at the beginning of the Book, by way of establishing how Esther came to be the Queen. Vashti was deposed because she refused the King's summons to appear at a banquet and display her beauty. Although some feminists interpret this as a refusal to appear naked, the Bible does not say this. Moreover, it seems that the most exhaustive collection of ancient Hebrew writings from the era of Esther contains no instances in which the Hebrew word that is used in the Biblical story to connote beauty is associated with nudity or indecency.

Whatever the precise nature of Vashti's defiance, it has been enough to propel her to iconic status at the expense of Esther. One Jewish feminist writes that "Vashti fights for her modesty and her honor while. . .Esther is willing to work through the bedroom." A female rabbi salutes Vashti as "the first woman in the Bible who refused to be objectified as a sex object, instead naming such behavior as inappropriate." But the best instance of Vashti worship comes from a Harvard professor who compares her to Hillary Clinton, with Bill Clinton as the King, and "Monica [Lewinsky], needless to say [as] Esther, the beautiful Jewess."

It is not necessarily unreasonable to put in a good word for Vashti. But the Jewish feminists have taken things way too far. As Schachter puts it, they have chosen to exalt "the non-Jew over the Jew and the failure over the success." Most importantly, they have exalted a self-centered act of courage (if courage is what Vashti displayed) over an unambiguous act of courage in defense of an entire people. Even if "the personal is the political," as feminists insist, not all politics is equal.

The modern treatment of Esther and Vashti is not an isolated event. Rather, it is an instance of what all too often passes for "literary criticism" at America's institutions of higher learning. The same kind of analysis is performed routinely on all works of literature, whether by feminists, race theorists, "queer" theorists, etc.

If one can take Vashti as far as the feminists have, there are no limits. And, based on my conversations with college students who are subjected to the stunts of modern English and other literature departments, indeed there aren't.

El choque, marcado por el tenso ambiente entre las dos aficiones tras los incidentes acaecidos en San Mamés, se puso pronto cuesta arriba para los vascos con un tempranero de Lukaku, ventaja que se ampliaría en una desafortunada jugada y luego se convertiría en justa goleada, vista la clara superioridad local.

Joaquín Caparrós, técnico del Athletic, intentó dar otro aire al equipo con Muniain, De Marcos y Gabilondo, pero los "leones" seguían sin ver portería.

El Anderlecht, envalentonado por el sorprendente resultado y animado por su hinchada eufórica, avisaron de nuevo al quedarse Boussoufa solo ante Iraizoz.

En una jugada de estrategia, Legear envió un misil a la escuadra de Iraizoz y acabó con las esperanzas vascas.

En el último tramo del partido, el Athletic, impotente ante un Anderlecht crecido, estuvo más cerca de encajar el quinto que de maquillar el resultado.

Gabilondo, con un disparo raso que se fue pegado al palo, fue quien más cerca estuvo de anotar el gol del honor.

Los rojiblancos fueron claramente dominados por el conjunto de Ariel Jacobs y pagaron caros sus errores defensivos, que aprovechó muy bien el Anderlecht desde los primeros compases del encuentro. El choque comenzó de la peor manera para los rojiblancos y ya hacía presagiar que la tarde no iba a traer nada positivo.

No se habían cumplido aún los tres minutos de partido cuando Lukaku recogió un balón entre líneas y batió a Iraizoz en el uno contra uno. Eso obligó a los de Caparrós a tomar el mando y asumir el control del partido, y a punto estuvieron de igualar la eliminatoria, pero Yeste y Llorente no estuvieron acertados ante Proto.

En esas llegó el segundo tanto de los 'púrpuras'. San José despejó hacia su portería un centro lateral y puso el 2-0 en el marcador ante la alegría de los seguidores locales. El Athletic lo siguió intentando sin acierto y el Anderlecht se movía como pez en el agua en las jugadas a la contra.

Caparrós dio salida a Muniain en el descanso para buscar la chispa del canterano y el Athletic gozó de un par de ocasiones para meterse en el partido pero las ilusiones de los bilbaínos se desvanecieron completamente cuando Juhász sentenció la eliminatoria al rematar de cabeza una falta en el minuto cinco de la reanudación.

Como las desgracias nunca vienen solas, Muniain tuvo que ser sustituido cuando no llevaba ni un cuarto de hora sobre el césped, aunque no parece que revista gravedad, y poco después, Legear se encargó de subir el cuarto tanto al luminosos con un golazo desde fuera del área.

Con todo ya decidido, el partido no tuvo historia y fueron pasando los minutos con ocasiones para ambos equipos que no llegaron a materializar. De esta forma, el conjunto rojiblanco se despide de la 'Europa League', competición que llevaba disputando desde el mes de julio, al tener que pasar dos rondas previas.

Einen Ausblick auf die Urlaubs, Freizeit- und Gartensaison des Jahres 2010 bietet vom 27. Februar bis 7. März die 42. Freizeit Messe Nürnberg. Die Messe tritt mit dem verkürzten Veranstaltungstitel Freizeit Messe an, der alle Angebotsbereiche in sich vereint. Darüber hinaus haben die veranstaltenden AFAG Messen und Ausstellungen an den konzeptionellen Inhalten gefeilt und die einzelnen fachlichen Bereiche der Messe stärker profiliert. Mit dem Ergebnis, dass sich die Freizeit Messe 2010 vielfältiger und informativer präsentiert und mit neuen Themen, Angeboten und Besucher-Aktionen eine Aufwertung erfährt.

Rund 600 Aussteller aus dem In- und Ausland werden im Nürnberger Messezentrum Frühlingsstimmung verbreiten und mit ihren Angeboten, Informationen und Dienstleistungen rund um Freizeitthemen die Hallen 4, 4A, 5, 6, 7 und 7A belegen. Die Messe gliedert sich in die Hauptbereiche Touristik, Camping und Caravaning, Garten, Haus & Lifestyle, Freizeit Zuhause und Outdoor-Sport sowie die Freizeit Selection, die als „Messe in der Messe“ konzipiert ist. Länderpräsentationen und Bühnenshows runden das Angebot der Messe ab.

Viel Neues beim „Internationalen Reisemarkt“: Urlaubskino, Verlosung von Urlaubsreisen und USA-Länderschau
Als führende Touristik-Messe Nordbayerns liefert der „Internationale Reisemarkt“ viele Anregungen für die nächste Urlaubsreise, von der Naherholung bis zur Fernreise. Das touristische Angebot hat an Vielfalt gewonnen und wird sich mit neuen Ausstellern und neuen Aktionsbereichen wesentlich interessanter präsentieren. Reisever-anstalter, Fremdenverkehrsregionen, Reisebüros und Hotels haben Urlaubstipps für jeden Anspruch und Geldbeutel im Angebot, von Flug-, Bus-, Bahn- und Schiffsreisen bis hin zum Urlaub mit dem eigenen Auto. Traditionell liegt der Schwerpunkt der Messe bei den deutschen und europäischen Reisezielen und auch die Naherho-lungsregionen sind wieder stark vertreten.
Das Touristik-Partnerland sind diesmal die USA, die sich als „Land der unbegrenzten Möglichkeiten“ und als attraktives Reiseland vorstellen. Einen kleinen Eindruck dessen, was die USA – von Florida bis Alaska – zu bieten haben, können die Messebesucher in Halle 7 erleben. Hier gibt es auch eine Showbühne mit täglichen Showdarbietungen, Tanz und Livemusik und bei American Food und leckeren amerikanischen Ice Cream kann man sich auch kulinarisch auf die USA einstimmen. Es werden typisch amerikanische Sportarten vorgestellt und wer die legendäre Route 66 mit der Harley befahren oder Kalifornien mit einem alten Ami-Schlitten erkunden möchte, kann sich bei Spezial-Reiseveranstaltern informieren. Eine Zeitreise zurück in die Zeit des Wilden Westen ermöglicht die kleine Westernstadt mit dem authentisch ausgestatteten Red Grizzly Western-Saloon. Hier sorgen die kanadischen Good Brothers mit Western- und Countrymusik für Stimmung. Kinder können sich im Goldwaschen versuchen oder im Indianer-Tipi Federschmuck herstellen und ganz Mutige können sich beim Bullriding beweisen.
Eine weitere Neuerung des Reisemarktes ist das Urlaubskino, in dem täglich Filme über reizvolle Urlaubsregionen im In- und Ausland gezeigt werden. Ebenfalls neu ist die Reise-Tombola, bei der auf der Showbühne täglich tolle Urlaubsreisen und Hotelaufenthalte verlost werden. Reiseinformationen erhalten die Besucher darüber hinaus auf den Ständen verschiedenster Verbände und Organisationen. So bietet z.B. der ADAC Nordbayern e.V. ein breites Spektrum an Serviceleistungen im Bereich Touristik und Camping sowie nützliche Reise- und Verkehrsinfos für Selbstfahrer.

Caravan- und Reisemobil-Salon mit Präsentation des Camping-Gastlandes Kärnten
Einer der größten Bereiche der Messe widmet sich in den Hallen 7A und 7 der mobilen Freizeit. Bayerns größte Messe für Reisemobile und Caravans zeigt ein breites Spektrum an Reisemobilen und Ca-ravans in- und ausländischer Marken. Besondere Beachtung werden auch diesmal die Modell-Neuheiten finden, die von Herstellern und den regionalen Handelspartnern präsentiert werden. Das Spektrum reicht vom kompakten Campingbus bis hin zum Luxusreisemobil mit allem erdenklichen Komfort und viel Platz für Mitreisende. Die Messe ermöglicht einen konzentrierten Überblick über das Angebot des Marktes. Konzentriert unter einem Dach bietet sich eine gute Gelegenheit, Preise, Design und Ausstattungen der Fahrzeuge zu vergleichen.
Neben den Neufahrzeugen findet man im Caravan-Salon auch Mietfahrzeuge. Wer sich nicht gleich für den Kauf eines Reisemobiles entscheiden möchte, hat die Möglichkeit, ein solches zu mieten, um erste Erfahrungen mit dieser unabhängigen Urlaubsform zu sammeln. Die GARTEN 2010 präsentiert sich in Halle 4 als wahres Eldorado für Hobbygärtner, denn hier kann man sich schon einmal auf die neue Gartensaison einstimmen und inspirieren lassen. Die GARTEN 2010 bietet nahezu alles, was des Hobbygärtners Herz begehrt, vom Rasenmäher über Gewächshäuser und Gartenmöbel bis hin zu Gartengeräten, Garten-Accessoires, Blumenzwiebeln und Pflanzen. Wer sich über die neuesten Gartentrends informieren möchte oder nach Produkten und Geräten Ausschau hält, die die tägliche Gar-tenarbeit erleichtern, ist hier genau richtig.
Die attraktiv gestalteten Garten-Welten liefern wertvolle Anregungen für das eigene Gartenparadies. Sechs prachtvolle Mustergärten widmen sich den Themen Rose, Duft, Vision, Ombrage (Schatten) und New Flower (Neuheiten). Alle Gärten sind überzeugende Beispiele, wie man durch kreative Gestaltungsmaßnahmen und den gezielten Einsatz von Blühpflanzen, Stauden, Steinen, Holz, Wasserflächen und Garten-Accessoires seine ganz persönliche Wohlfühl-Oase schaffen kann. In einem weiteren Bereich stellen sich regionale Betriebe des Bundesverbandes Garten-, Landschafts- und Sportplatzbau e.V. mit weiteren Beispielen einer gelungenen Gartengestaltung vor. Hier bekommt man auch eine qualifizierte Beratung rund um die Neuanlage eines Gartens oder die Umgestaltung bestehender Gärten. Im grünen Infozentrum der Gartenhalle stehen außerdem zahlreiche Gartenverbände und -vereine sowie Naturschutzorganisationen den Besuchern für die Beantwortung von Fragen zur Verfügung. Zum Kreis der Aussteller gehören u.a. die Deutsche Fuchsiengesellschaft, der Bayerische Siedlerbund, der Stadtverband Nürnberger Kleingärtner, der Bund Naturschutz, der Bund Deutscher Baumschulen, die Staudengärtnerei Augustin und der Zeidlerverein.

Rund um den Outdoor-Sport
Möglichkeiten, seine Freizeit mit Outdoor-Aktivitäten zu verbringen, gibt es viele. So wird auch die Messe in Halle 6 den Fokus auf den Outdoor-Sport richten und dazu das passende Angebot präsentie-ren. Das Spektrum reicht von Wandern und Nordic Walking über den Berg- und Klettersport bis hin zum Radfahren oder Kanusport. Dabei können die Besucher teilweise auch selbst aktiv werden, z.B. beim Klettern, auf dem Fahrrad-Testparcours oder im großen 40.000 Liter Tauchturm des Tauchsport-Kompetenzzentrums. Messebesu-chern bietet sich hier eine kostenlose Gelegenheit zum Schnuppertauchen unter Anleitung erfahrener Tauchlehrer. Die Ausrüstung und Handtücher werden gestellt, mitzubringen sind lediglich Badesachen. Die Tauchprofis gewähren bei täglichen Darbietungen im Tauchturm interessante Einblicke in die große Faszination dieses beliebten Freizeitsports. Informiert wird u. a. über die Tauchausbildung und die neueste Ausrüstung für Taucher werden vorgestellt.
Da die nordbayerische Region mit Main und Donau, dem Fränkischen und Oberpfälzer Seenland sowie weiteren beliebten Flussrevieren den Wassersportanhängern viel zu bieten hat, ist die Nürnberger Freizeit Messe eine gute Gelegenheit, um sich über die verschiedensten Wassersportaktivitäten zu informieren. Hier findet man auch die für unsere Wasserreviere geeigneten Boote, vom Motorboot und Schlauchboot bis hin zum Paddelboot oder Kanu. Wassersportzubehör, Informationen der Wasserwacht, die Ausbildung zum Sportbootführerschein oder der Schiffs-Modellbau sind weitere Themen in dieser Halle.

Gastland der Freizeit Messe: Russland stellt sich vor
Russland, das diesjährige Gastland der Freizeit-Messe, wird sich ebenfalls in Halle 6 vorstellen. Vor eindrucksvollen Hintergrundkulissen mit russischen Motiven und Sehenswürdigkeiten kann man sich bei den Ausstellern und auf den Infoständen informieren und mehr über dieses riesige Land erfahren.
Touristische Informationen über Russland bilden dabei einen Schwerpunkt. Eine fachkundige Beratung über Sehenswürdigkeiten, Städtetouren, Flusskreuzfahrten oder Fahrten mit der Transsibirischen Eisenbahn erhält man bei einem auf Russlandreisen spezialisierten Reisebüro. Auf dem Infostand von Fairtrade Tours gibt es ebenfalls Informationen über Russlandreisen, Sprachreisen, Visumbestimmungen und Flugverbindungen, u.a. auch ab Nürnberg. Stände mit russischen Lebensmitteln und Spirituosen sowie typisch russischen Geschenkartikeln gehören ebenso zum Angebot der Russland-Präsentation. Darüber hinaus besteht Gelegenheit, auf der Messe die kulinarischen Spezialitäten Russlands zu probieren.
Auf der Aktionsbühne finden täglich verschiedenste Darbietungen statt, für die größtenteils das Russisch-Deutsche Kulturzentrum e.V. verantwortlich zeichnet. Dazu gehören u.a. Auftritte der Volkstanzgruppe Kalinka und des Theaters Confetti. Russische Tänze zeigt auch die Tanzschule Franz Hof, bei der man diese auch erlernen kann.
Zu einer Kunstausstellung mit russischen Motiven laden die beiden Künstlerinnen Marina Vestfrid (Moskau) und Natalia Zhuravskaja (St. Petersburg) ein. Holzschnitzkunst im Volksstil führt der russische Holzschnitzer Vladimir Karius vor, der aus Barnaul, Region Altaj, stammt. Elena Bader aus Moskau wird die Serviettentechnik Decoupage in russischem Volksstil vorführen.
Aus Russland kommen bekanntlich einige der weltbesten Schach-spieler, denn das Schachspielen ist hier Nationalsport. So gibt es auch in der Russland-Schau für die Besucher eine Schach-Ecke. Die russische Schachlehrerin Anna Yuryeva aus Pskov bietet Schachkurse für Anfänger an und veranstaltet während der Messe ein Blitz Schachturnier. Abgerundet wird das Programm durch Filme über Russland, bei denen man viel über Land und Leute und die Geschichte Russlands erfährt.
Viele Russen haben in Deutschland eine neue Heimat gefunden und in Nürnberg sind die russischen Mitbürger nach den Türken bereits die zweitgrößte Migrantengruppe. Mit der Präsentation des Gastlan-des Russland auf der Freizeit-Messe bringt man den Besuchern dieses faszinierende Land ein Stück näher und schlägt eine Brücke zwischen deutschen und russischen Mitbürgern.

Freizeit Selection: Shopping-Erlebnis für Premium-Kunden
Die Freizeit Selection wendet sich an Premium-Kunden, die einen gehobenen Lebensstil schätzen und das Besondere suchen. Hier stehen Produkte und Dienstleistungen aus dem Freizeitbereich im Mittelpunkt, die auf eine anspruchsvolle Kundschaft ausgerichtet sind. Entsprechend sorgfältig haben die Veranstalter die Aussteller und Angebote für diesen Messebereich ausgewählt.

Das Angebotsspektrum umfasst u.a. individuelle Urlaubangebote fernab des Pauschaltourismus, Angebote rund um die Themen Wellness & Gesundheit sowie Ideen und Accessoires für den Garten, präsentiert von regionalen und überregionalen Anbietern. Reizvolle optische Blickfänge der Freizeit Selection sind die farbenprächtigen Gestaltungsideen und Arrangements der Floristen.

März in Halle 4A statt und präsentiert aktuelle Modelle und Neuheiten in- und ausländischer Automobilmarken. Jon Stirling is a Baltimore Orioles' loyalist. He started following the Birds when they arrived just in time for the 1954 season.

Jon never liked the haughty Yankees, but he grudgingly admired the greatest of all center fielders, Joseph Paul DiMaggio.

On Saturday, July 31, 1965, Jon attended the Yankees' annual Old Timers' Game at Yankee Stadium, a ball park that greed recently destroyed.

The Yankees' lost, but Joe DiMaggio, at the age of 51, again confirmed his greatness.

Easy to Root Against the Yankees

It started even before the St. Louis Browns moved to Baltimore. During the winter of 1954, the New York Yankees stole our best pitcher, Bullet Bob Turley.

After that, it was even easier to root against the Yankees, an exercise that didn't produced much satisfaction until 1965, when age and deliberately poor management by new owner CBS, caused the demise of baseball's dynasty.

Old Timers' Game

I was in New York on business at the end of July. The Yankees were hosting the Cleveland Indians on Saturday, July 31, and I had two tickets.

I called my friend, Mike Phransessa, to ask him if he wanted to go to the game. The grabber was that it was also Old Timers' Day. Mike, who was an avid Yankees' fan, jumped at the chance.

The Yankees Were Bad

As we walked into Yankee Stadium, I felt great, because for the first time that I could remember, the Yankees were a bad team.

The Old Timers' game pitted National League players who had won awards against their American League counterparts.

A Great Ovation for Yogi Berra

Yogi Berra, whom the Yankees fired in favor of their 1964 World Series conquerer, Johnny Keane, received a tremendous ovation when he was introduced, which was in stark contrast to the chorus of boos that had rained down on Keane a little earlier.

I, of course, cheered the Keane, but even I could not boo Yogi Berra.

A few minutes later, the thunderous applause Yogi received paled in comparison to the fans' frenzy when Joe DiMaggio was introduced.

I admit it. I was among those who cheered the loudest for the man who was the living symbol of Yankees' greatness.

For the moment, it was easy to forget all the negatives. It was easy to forget the way the Yankees had used Kansas City as a farm team, and how they always took advantage of financially challenged franchises.

Joe DiMaggio Hits

No one could question Joe DiMaggio's greatness, but one could question, at least to some extent, what occurred in the second inning.

After the National League stars scored four runs in the top of the second, Joe led off the bottom of the inning against former Cincinnati Reds' right-hander Bucky Walters.

As the crowd watched with eager anticipation, Walters went into an exaggerated wind-up. after first asking where Joe wanted the pitch.

It reminded me of an article I had read on Bleacher Report that discussed how batters could request pitch location in the 1880s.

A Foul Pop Fly

DiMaggio merely smiled at Bucky, who delivered the pitch. The Yankee Clipper hit a high foul pop fly in foul territory behind home plate.

Catcher Jim Hegan moved under the ball, hesitated, caught it, and then walked a few steps before purposely touching the ball to the ground.

The "Clown Prince of Baseball," Al Schacht, who was umpiring, insisted that DiMaggio continue to bat. The crowd roared in approval. Mike told me that it was the right thing to do as I shook my head.

Another Chance

Joe stepped back into the batters box. Walters delivered and DiMaggio lifted another pop fly, this time near third base.

Monte Irvin, who was playing third, decided to attempt an awkward, running, backhand catch. To his and the crowd's amazement, Irvin made the play, but Schacht ruled that backhanded catches were illegal.

The Third Time

During his career, Joe DiMaggio hit 361 home runs and struck out 369 times. It was extremely difficult to get a third strike past him. On this day, Bucky Walters couldn't get DiMaggio out a third time.

Given new life, Joe took his signature wide stance as Walters delivered.

Joe lined the delivery into the left field stands for a home run.

The crowd was uncontrollably wild as Joe circled the bases.

"As DiMaggio trotted around the bases, the pennants attached to the grandstand roof seemed to flap in recognition and memories of invincibility lived again."

None was "Joe DiMaggio"

My friend Mike was besides himself, and he was not alone. I could hardly hear him as he shouted to me about DiMaggio's greatness.

"You can have Mantle, Mays, Snider, and even Speaker. You give me Joe."

I had to admit that it was thrilling. Yes, DiMaggio had been retired twice before he connected for the home run, but seeing Joe DiMaggio round the bases on more time was indescribable.

I saw Mickey, Willie, and the Duke. I read about Tris Speaker. Each was unique in his own way, but none was Joe DiMaggio.

While I generally enjoyed Red Faction: Guerrilla, last year's third-person action game from Volition and THQ, there was one type of mission on which I was lukewarm: The delivery missions where you were tasked with hopping in a vehicle and blundering over the Martian landscape to reach an arbitrary checkpoint before an equally arbitrary timer ran out. Meh. Kind of boring.

And it wasn't the first time. As a gameplay mechanic or goal, lots of games require you to complete challenges within a certain amount of time. Guitar Hero 5 and The Beatles: Rock Band have rewards for playing set lists within 1 hour and 1 day, respectively.

And sometimes games inverse the formula and challenge you to keep the clock running by staying alive, such as in Left 4 Dead's survival mode. But it's generally the same goal: keep an eye on the timer and play the game, whether the specific task is mundane (driving across featureless plains or repetitive race tracks) or thrilling (fending off hoards of zombies).

Quick Clocks and Annoying Sounds: They Go Together Well

Turns out that recent research by Aaron Sackett at the University of Chicago and his colleagues suggests a way that game designers could manipulate your perceptions of time to make these parts of the game more fun. In one study, the researchers had subjects listen to an annoying sound while they watched a timer tick the seconds off.

For half the people, the timer was sped up by 20%; for others it was slowed down by 20%. Afterwords, subjects were asked the (frankly absurd) question of how enjoyable that all was. The result? Those whose clocks were sped up by 20% actually said the annoying sound was more enjoyable. Well, less terrible. Close enough.

But the phenomenon held true when people were doing something enjoyable to begin with. In a follow-up study, Sackett et al. had subjects listen to popular songs where the digital music player showed elapsed time for the track. In one group, the timer was sped up by 20% and in another it was slowed by the same amount. Again, people found this already pleasurable event even more enjoyable when they thought that time was passing more quickly and found it less enjoyable when time seemed to pass more slowly.

This Reminds Me of a Story About The Morbidly Obese and Crackers

In fact, research on the effects of external cues (like clocks) on internal states (like having so much fun you make a mess all over yourself) is pretty well established. In the late 1960s psychologist Stanley Schachter and his colleagues locked a bunch of subjects in room full of crackers. Well, something along those lines.

Also in the room was a clock, which the experimenters rigged to run either fast or slow. They found that people --especially obese people-- tended to eat more crackers when time was sped up, especially when the clocks (incorrectly) said it was near dinner time. This happened even when dinner time was actually a long time away.

But enough about saltines and fat people. Let's go back to Sackett and his study of how the same idea affects perceptions of fun. He and his researchers ran several more experiments, but the common theory explaining all their results was that when people experience unexpected distortions of time (i.e., time seemed to pass faster or slower than expected) they seek an explanation by turning to what psychologists call "metacognition," or "thinking about thinking."

Specifically, Sackett hypothesizes that when faced with apparent time distortions people turned to the axiom that "time flies when you're having fun" and concluded that because time flew (or dragged) they had fun (or didn't). So much so that it affected how much fun they reported having and how likely they were to switch to other activities. He even did some additional studies where he manipulated the salience of this explanation in subjects' minds and thus increased its effect. Perceptions of time were affecting how much they enjoyed the game, not the other way around!

So How Do You Use This For Fun and Profit?

This has several interesting implications for game design. One devious thought (I have those occasionally) that comes to mind deals with timed game demos. You could tell players that your demo will allow players to enjoy the game for 20 minutes before ending, then cut them off after 15 minutes. According to the above theory, people should think that those 5 minutes went missing on account of all the fun they were having. Hey, they liked your demo more! Free yachts for all the psychologists on staff!

But I can hear you the popping sound of your collective manacles now as you contemplate this base act of fibbing. You sound just like the Human Subjects Review Board when they told me I couldn't have a "clubbed into unconsciousness" condition in the experimental design for my dissertation research. Fine, fine, other applications could rely less on such crass deception. Or clubbing.

Take the driving missions in Red Faction: Guerrilla that I mentioned earlier. Speeding up the clock (after making adjustments to hold difficulty constant) should make that mundane task seem more enjoyable. Same for survival mode in Left 4 Dead or any other game that features a "fend off attackers for X minutes" mission. It would be interesting to see what would happen if you had the game say something like "Hold the enemies off for five minutes," then NOT show a timer and then declare the challenge complete after just three minutes. If the research described above is to be believed, you should have more fun as long as you're not aware of the time compression.

Sure, hardcore gamers armed with stopwatches and preconceived outbursts will probably eventually figure it out, but I'll bet a lot of them don't and never hear about it from others. Or you could sidestep the issue altogether by replacing your timer with an on-screen circle that disappears in tiny wedges reminiscent of the points on a clock face, but at a pace that you control.

Heck, you can even add a little sweeping second hand if your User Interface Design person doesn't have plans for the evening. If a little change in how the concept of time is presented makes for a noticeable change in how much players enjoy those bits of the game, it's worth it.
