The IPKat has been perusing the recent Hague District Court decision concerning the dramatic fate of the PINK RIBBON trade mark application. The "pink ribbon" concept is one which is well known wherever the battle against breast cancer is fought.  The Pink Ribbon Foundation, which was formed in the Netherlands in the 2003, has a number of trade mark registrations for figurative marks incorporating the words "pink ribbon" and device (see eg the mark on the right), among which are some Benelux registrations. The sign was originally used in the 1990s; the Foundation was formed by some of those entities which supported it.

In 2008 the defendant in these proceedings -- an internet trader -- incorporated a company, Pink Ribbon, Inc. which purported to have the same laudable aim as the Foundation, and sought to file various word and figurative signs, including PINK RIBBON, RIBBON OF PINK, PINK RIBBON INTERNATIONAL and PINK RIBBON MAGAZINE as Community and Benelux trade marks. While the right to file a trade mark is normally assumed to be a perfectly legitimate business activity, and indeed is a statutory entitlement in the Benelux, the defendant's conduct was not entirely commendable.  In particular,

• he withdrew the applications right after the Pink Ribbon Foundation had substantiated its oppositions and incurred considerable costs, and then filed new ones, or had them nullified right after the Pink Ribbon Foundation initiated summary proceedings, by not paying the fees due;
  
• he filed applications in various languages in order to drive up the Foundation's translation costs;
  
• his filing was done in the full knowledge that these could violate existing registrations;
  
• his filings related not only to breast cancer-related goods and services but also to firearms, incubators and carcinogenic substances such as asbestos and tobacco.

No rational explanation was offered for this peculiar behaviour.

The Foundation sued for injunctive relief which included an order that the defendant be prohibited from filing further applications containing the words PINK and RIBBON. The defendant counterclaimed for invalidity of the Foundation's trade marks.

The Court held the Foundation's marks valid and did indeed order the defendant not only to stop infringing the Foundation's marks but not to file further marks as requested by the Foundation. In the event of a breach of this order, a penalty will be exacted to the value of EUR 10,000 per day or per event, as the case may be.

According to Marlou L.J. van de Braak (Hoyng Monegier, Amsterdam, The Netherlands), who acted for the Pink Ribbon Foundation, this may well be the first time a court has ordered a party to refrain from applying for any Benelux or Community trade mark registrations. The Kat can't recall this happening either, and wonders if readers in other countries have ever seen or had experience of such an order.

At the Rijksmuseum in Amsterdam, the contemporary German artist Anselm Kiefer reinterprets two great Dutch masters, Rembrandt van Rijn and Vincent Van Gogh.

Last week, Ned Ludd's Jason French sang the praises of the foie gras torchon that Traci Des Jardins serves at Jardinière in San Francisco. Now it's Des Jardins's turn to tell us which dish she finds herself dreaming about. Take it away, Traci.

"I was on a stopover from Amsterdam back to San Francisco a few weeks ago, and I popped into Anissa for a quick bite at the bar with a friend. We had the amazing braised wild-boar belly, which was probably inspired by our boar-hunting trip to Mongolia last year. Or at least Anita was probably inspired to send it to me for that reason. Anyway, it was delicious — crunchy tempura-fried Unagi [freshwater eel] with tender, succulent, delicious braised boar. And a great hit of acid from the green apple. The textures and flavors struck a perfect balance."

Anita Lo, Annisa's executive chef and owner, responds:

"The wild-boar belly is braised in dashi with daikon and ginger. Then it's topped with a soy glaze and unagi tempura. In the center is a small salad of fuji apple and shiso with wasabi, and on the right, a spherification of the hot braising liquid, which is topped with a little scallion and bonito."

Ron Mandos Amsterdam is excited to announce thelatest solo exhibition of Levi van Veluw. 

Levi van Veluw will showcase new work from a series of new installations, photographs and videos in which he draws from his own childhood memories to thematically and narratively develop his own brand of self-portraiture.

The artist has created 3 “rooms” covered with more then 30.000 wooden blocks, balls and slats respectively.  Each“room” is executed as a life-size installation (4m x 2.5m x 2.5m) and will be presented at the gallery together with photographs and videos.  Portrayed in one piece is a desk, a table lamp, a bookcase. The edge of the table is burned by Levi van Veluw as he had an obsessionfor fire. All of these objects including every inch of the floor, walls and ceiling is covered in the same material: 14.000 4 cm2 dark brown wooden blocks. The blocks are made by the artist and glued on the wall one by one. The works suggest a narrative world behind the abstractportraits.On the one hand these works present themselves as a continuation of van Veluw’s formal approach to self-portraiture, with their preoccupation for materiality, pattern and texture. Yet they are simultaneously very personal pieces. The repetitive structures seemingly express a ‘horrorvacui’ and recall van Veluw the youth and his obsessive attempts to gain control on his life by gaining control of his surroundings. Dimly light and dark in colour the overriding tone of these pieces are claustrophobic and sombre, exuding a sense of loneliness. The meticulous craftsmanship and high quality material with which every last knock and cranny is covered, result in a series of works that are also highly aesthetic.These installations are inspired by different aspects of van Veluw's boyhood bedroom, where he spent many solitary hours between the ages of 8 and 14: Origin of the Beginning.

Arriving at Schipol, you can take a taxi to The Hague (around € 45) or for the budget conscious traveler, you can take the train (€ 7.90) to go to the Hague. Within The Hague, transport seems to consist of many, many cyclists, trams and cars. There are two bikes per Dutch person in the Netherlands, but despite knowing that the Dutch use bikes as the main way of getting around within the towns, it’s still a surprise to see all the people cycling to work, to the pubs, to the stores and pretty much everywhere.

When crossing roads, keep an eye out for the bike lane, the tram lane, AND the car lane. And you might want to obey the traffic lights as well, as the pedestrians also wait for the pedestrian crossing light to turn green before crossing, even in the absence of incoming cars. When being driven within The Hague, you might decry all the “wasted” driving lanes that are taken up by the bicycle lanes, but there is no overlapping from drivers into the bike lanes as the cyclists also seem to have significant cycling rights.

For accommodation in The Hague, there are a range of hotels to choose from. The Ibis hotel, part of an European chain is a pretty safe bet (€99 before tax), and is an environmentally friendly hotel , no frills hotel. Prepare for sticker shock for meals though as breakfast goes for €15.

You can get around even if you speak no Dutch, as almost everyone in the service and retail industry speaks English. Window-shop in the Noordeinde area which has really high end shops located near the Noordeinde Palace. Make sure you soak in the old architecture while you’re there (Google says the Palace was built in the 16th century). The real shopping takes place in Grote Marktstraat where many retail electronics, clothing, shoes, bath and body retails chains have stores, and there are plenty of small shops that sell the distinctive blue and white Delft pottery.

To get the full tourist experience, take a day trip to Amsterdam which has great shopping and tourist attractions. The Van Gogh Museum and the Rijk Museum are must sees. For sightseeing and shopping, a good place to start is Dam Square where shops are flanked by waterways, and with tourists attractions like Madame Tussauds . Many of the international chains have retails stores in this area. Amsterdam isn’t of course Amsterdam without a visit to the Red Light District, so if you can, try and see that as well.

Biggest surprise about Holland? That the dikes aren’t brick walls that prevent the sea from flooding the country. They’re more miles and miles of mounds of earth. Oh, and this boy? He never existed as part of Dutch history. It’s an American children’s story!

Cult burger shop Shake Shack has gone from an instantly popular Midwestern-style patty pusher to an international chain in just under five years. But while shack burgers and Chicago dogs can be had from South Beach to Dubai, nothing beats ordering the original burger at its birthplace in Madison Square Park. One nice by-product of expansion is that the perpetual line that wraps around the burger joint has lessened of late. Go on a nice day and order their thin classic shack burger, adorned with cheese, lettuce, tomato, and shack sauce. Vegetarians should try a fries side and their cheesy 'shroom burger. And it would be a shame to wait in that line and not try their criminally thick custard.

Fatty Crab

Restaurateur Zak Pelaccio has made a name for himself in New York for his knack for creating fun, hip, casual restaurants with great cocktails at the bar, killer tunes on the stereo, and saucy, spicy, deliciously addictive food on the menu. To get a taste of his adventurous offerings on the staid Upper West Side, check out Fatty Crab, his large Malaysian-inspired spot on Broadway and 77th. Expect all kinds of spices, sauces, noodles, curries, stews, and seafood, and while the menu rotates with regularity, classics like their fatty duck (duck is brined and fried) and Dungeness chilli crab are mainstays. Oh, and be prepared to eat with your hands and share with the rest of the table.

Cascabel Taqueria

Too often, food on the Upper East Side is either strikingly mediocre or exorbitantly expensive. So it was a relief to both the locals and the occasional uptown visitors when this minuscule taqueria opened in the area in 2009. The Mexican spot – serving high quality but affordable tacos and street food counter-style – was so overwhelmed by the early response that within the first year they had to relocate to a larger space up the block. Now they're expanding across town to the Upper West Side. Don't miss the tacos, made from special nixtamal corn, the house-made chorizo and their monster cemita poblana. And why not wash it down with a margarita?

Salumeria Rosi Parmacotto

Salumeria Rosi pretty much defines the idea of a "neighbourhood spot". It's a take-out meat and deli counter supplying locals with the some of the best cured meat in the city, along with pantry staples like olive oil and roasted peppers. But it's also a small restaurant, perfect for a snack and a drink – white anchovies marinated in oil or some chickpea crostinis. Or go for a nice, lingering meal of meats, cheeses and delectable Italian soups, salads and traditional hot dishes like short ribs, stewed tripe and lasagna. Everything is served in small, not so pricey portions, so diners can customise a dinner to their liking and budget.

Red Rooster Harlem

Celebrity chef Marcus Samuelsson's vibrant Harlem restaurant Red Rooster was one of the hottest spots to open this year, and it continues to thrive after the initial buzz. The locals, food obsessives from uptown and down and those just curious to check out the scene pile into the restaurant and sup on Samuelsson's menu of soul food classics with riffs from his Ethiopian and Swedish backgrounds. The chef can be found either toiling away at the warm hearth of the open kitchen or in the dining room glad-handing Harlem dignitaries and NYC food celebs. Make sure to try the cornbread and the spicy fried yard bird.

JG Melon

The ambience of this old-school, dimly lit, somewhat kitschy Upper East Side bar merits the visit alone, but it's JG Melon's famous burgers that have kept the restaurant relevant since it opened in 1972. Melon serves a juicy, sizable (but not unmanageable) pub burger grilled on a well-seasoned flat-top and served on a lightly toasted bun with red onions and pickles. Get it. Maybe even with some bacon on top and a side of quarter-sized cottage fries and beers. Just keep in mind that this is quite the popular spot both with the locals and tourists, so there will most likely be a wait. Another thing to be prepared for: authentically gruff service.

Viand Coffee Shop

This is about as classic Manhattan as you get. Viand is a long, slim, shoebox of a diner space lined on one side with small booths and on the other with a white Formica counter. The service is surly yet jovial and fast as can be, and they serve everything a New York diner should – milkshakes, coffee, burgers, chicken salad sandwiches, egg sandwiches on Kaiser rolls, black and white cookies, and Nova lox. While prices are slightly high for diner fare (sandwiches hover around $10) keep in mind it's located on Madison Avenue, just across the street from Manhattan's most overpriced restaurant, the celeb-magnet Nello. There are now other Viands around town, but the original is by far the best.

Má Pêche

Celebrity chef David Chang's first foray outside of the East Village, Má Pêche, is an interesting amalgam. It encompasses both Midtown fine dining and the Downtown rock'n'roll attitude and flavour-forward mentality that made him famous. The space is large and sweeping, with ample room for diners to move and stretch (rarely the case downtown). And the menu includes items like an exceptional grand plateau, steak frites, addictive brussels sprouts, and more adventurous fare like crispy pig's head. Hardcore food fanatics who want to make a night of it can try the large-format meal, Beef 7 Ways, which includes côte de boeuf, a prehistoric-sized beef shank, and much more.

Sushi Yasuda

Though New York may not boast the same high-end sushi scene as San Francisco or LA, it does have a few heavy hitters when it comes to immaculately fresh fish. There's Sushi Seki, Sushi of Gari, the exorbitantly expensive Masa, 15 East, and then what many consider to be the very best, Sushi Yasuda. Just last year, sushi master Naomichi Yasuda left the restaurant to open a new spot in Japan. But his fans and restaurant critics report that he's left it in capable hands. An omakase meal will run just over $100 a head, normal for this quality, and will consist of hard-to-find fish, simply and wonderfully prepared.

Madangsui

Where can you find karaoke joints galore, 24-hour restaurants, fried chicken spots, noodle houses, tofu masters, bibimbap, and scallion pancakes? Why, Midtown's Korea Town of course, where an adventurous eater can find all that plus some of the best Korean barbecue this side of Flushing. Head specifically to Madangsui, a Korean barbecue spot that earned a star from New York Times critic Sam Sifton. After every inch of the table is covered with banchan - sides and accompaniments like kimchi, seaweed, crabmeat slaw – it's time to make use of the grill in the middle of the table.
