John Bravata, a real estate investor accused in 2009 of operating a Ponzi scheme, has been arrested on federal wire fraud charges and is being held in New York, according to the U.S. Attorney’s Office.The founder and chairman of BBC Equities LLC and Bravata Financial Group LLC is accused of knowingly defrauding investors from 2006 to 2009, according to a criminal complaint filed with the U.S. District Court in Detroit. The companies had two offices in Perrysburg, though the complaint shows that the firms operated in Southfield, Mich.Mr. Bravata was arrested Thursday at JFK International Airport in New York, where he had just returned from a trip to Italy. He remained in custody in New York and is awaiting U.S. marshals to transport him to Detroit, a spokesman for the attorney’s office in Detroit said.The complaint said Mr. Bravata’s companies collected more than $50 million from investors but invested only $20.7 million in real estate. A “significant portion” of the remainder allegedly went toward Mr. Bravata’s personal expenses, including construction of an 18,000-square-foot home.Federal investigators also say Mr. Bravata misled investors about the security of their proceeds and the companies’ profitability. If convicted, Mr. Bravata faces up to 20 years in prison and a $250,000 fine.It was not immediately known on Friday whether Mr. Bravata has legal representation.The U.S. Securities and Exchange Commission filed a civil suit in 2009 against Mr. Bravata and his business partner, Richard Trabulsy, as well as BBC Equities and Bravata Financial.The suit, which also named Mr. Bravata’s wife and son, alleged a wide-ranging securities fraud in which the two men used the assets from at least 440 investors to live lavish lifestyles. The suit also alleged the men and their companies used investors’ funds to make quarterly payments to earlier investors who had been promised annual returns of as much as 12 percent.That case is still being considered in U.S. District Court. Clearing world rights of an underlying source for translation, adaptation or republication is invariably a cumbersome complicated lengthy process. Clearing rights serves a very important purpose in entertainment transactions, as such rights supplant and serve as future sources of income. Hence, it behooves entertainment participants to ascertain their salience and take proper legitimate steps to implement them.

SALIENCE OF RIGHTS CLEARANCE

Clearing rights is a sine qua non to financing and distribution of any legitimate entertainment-related product. In fact, such rights are as lofty, worthy and valuable as property rights and, as indicated, serve as future sources of income.

SALIENCE OF DETERMINING WHICH RIGHTS TO BE CLEARED

Most probably, it is rather financially and practically impossible to clear world rights of an entertainment product for all uses thinkable, imaginable and available. Hence, it is incumbent to first ascertain what the available budget for rights licensing is and the urgency expected to implement such rights clearances.

Most probably, the rights to be cleared are the ones needed to generate sufficient income to recover investment and be profitable.

SALIENCE OF REPUBLICATION RIGHTS AND ADAPTATION RIGHTS

Most generally, clearance of rights could be divided into two major groups:

1. REPUBLICATION RIGHTS

Republication rights encompass rights of reproduction, display and publication where the underlying source material is reused in the form of the original work.

CLEARING RIGHTS FOR REPUBLICATION

Generally, clearing rights for republication relatively involves less cumbersome procedures. Often, the publisher through contractual agreements aspire to share in the proceeds of subsidiary-rights licenses for the underlying work it owns. It is imperative to note republication of the underlying work PER SE does NOT create a new copyrightable product. The latter point has some exception including but not limited to possible copyrights for: organization, layout, epilogue, design or a new preface, among other things.

Nevertheless, it is imperative to still review the subsidiary rights previously granted to ensure no violation or conflict with previous licenses.

2. ADAPTATION RIGHTS

Adaptation rights encompass the rights where the underlying source material is to be transferred to a totally new work with its own rights to copyright protection.

CLEARING RIGHTS FOR ADAPTATION

Clearing rights for adaptation is relatively much more complicated cumbersome and lengthy as a new work with its own copyrightable rights and privileges is created.  Therefore, for such rights, it is VITAL to establish:

• Whether the rights to adapt for the underlying work is available
• Whether the rights to adapt conflict with other subsidiary rights already granted to others in the underlying work. 

SALIENT NOTE

This article presents a very rudimentary general understanding of such complicated subject matter.

The house we live in now in NY was my mother-in -laws. But because of the living trust under my wifes name the tax bill is now coming under my wifes name. A elder will lawyer told us not to claim the NY taxes because we don't actually own the house even though the real estate Tax bill comes under our name. He said we are actually just the owners of her living trust. The deed shows my wife was given the house in a living trust. Being we are not claiming our NY Real Esate taxes on our federal return , would we be able to claim our taxes and interest on mortgage if we buy the House in NJ even though its still not our primary residence yet. We might not move in full time for 3-4 years.

Mastro no longer requires a guardian and is competent to testify at his trial, according to a ruling this morning by U.S. Bankruptcy Judge Marc Barreca, in Seattle. Daniel Massey - In recent months, proponents of a bill to mandate so-called living wages at city-subsidized projects have attended rallies, delivered sermons and sent postcards to elected officials in support of the measure. Meanwhile, little has been heard from opponents of the measure. But that is about to change.

With a City Council hearing on the bill set for Thursday, and officials from the city's Economic Development Corp. preparing to brief stakeholders next week on the results of its $1 million study on the feasibility of wage mandates, opposition to the measure is mounting.

More than a dozen groups—ranging from small business owners and supermarket operators to major real estate developers and builders of affordable housing—have formed a coalition to press for the bill's defeat.

They plan to use Putting New Yorkers to Work, a nonprofit registered late last year by the Real Estate Board of New York, to educate the public about the bill's potential impact via advertisements, mailers and other methods. And they have hired the public relations firm The Marino Organization to get their message out.

Groups that have joined the coalition against the bill—which would require employers at projects that receive $100,000 or more in subsidies to pay $10 an hour plus benefits, or $11.50 without benefits—include REBNY, the International Council of Shopping Centers, the Five Boro Chamber Alliance and the Food Industry Alliance of New York State.

City Councilman Oliver Koppell, the bill's prime sponsor, said that recent amendments to the bill were designed to ensure affordable housing, nonprofits, and small businesses are not adversely affected. “These amendments are the direct result of conversations with top stakeholders who represent those interests,” he said.

Affordable housing developers are worried, despite an amendment to the bill that would exempt most projects in which 75% of the residential units are affordable for families earning less than 125% of the area median income. Coalition insiders say that the city's Department of Housing Preservation and Development will come out against the bill, but a spokesman for the agency declined to comment.

Affordable housing developers are concerned because most large affordable residential developments include ground floor retail that helps reduce the subsidy needed to finance the affordable units. Increased wage requirements would reduce the value of the retail space, which would then necessitate adding more government subsidy and/or a reduction in the number of affordable units that could be built.

“We're trying to bring retail into underserved neighborhoods like [Brooklyn's] East New York and Brownsville,” said one affordable housing developer in the city. “We have a hard enough time getting retail to locate in these areas and getting rents low enough to attract people, but with this bill any project we're working on, we'd have to get rid of non-residential space.”

Opposition also extends to officials representing other types of housing. The Council of Cooperatives and Condominiums is against the bill, according to Arthur Weinstein, a vice president and member of the board of the association. He said it would “wreak havoc” on buildings that received J-51 tax abatements to make improvements.

“It would place an unbearable burden on co-ops and condos that use a myriad of contractors to check on the wages of every worker,” he said. “To be faced with tracking down wages paid by contractors to every single employee is absolutely outrageous.”

Supermarket owners are also up in arms, said Pat Brodhagen, vice president of the Food Industry Alliance of New York State, who contends the bill would mean the end of the FRESH program, which the City Council, industry and labor designed to bring grocery stores to underserved neighborhoods. She plans to testify against the bill at the Council hearing next week.

“Supermarket careers are good careers long term, but the entry wage is not going to hit this level,” she said. “What will happen, as a store does its pro forma and looks at the numbers, it will no longer be a project they're willing to enter into. It will undo the whole purpose of the benefits under FRESH.”

Tenants at the Brooklyn Navy Yard have also joined the coalition, arguing the bill would hurt the competitiveness of their businesses. Joal Savino, executive vice president at Mercedes Distribution Center, which fulfills orders for e-commerce sites, said the bill would force him to relocate to Pennsylvania.

“It puts me out of business here,” he said. “And that's not just affecting workers making minimum wage. It's affecting everybody. I have IT guys making $120,000 a year, warehouse managers earning $65,000 with full family medical coverage.”

Small businesses, via the Five Boro Chamber Alliance, have also expressed opposition. Firms with less than $1 million in revenue are exempted, but Nancy Ploeger, president of the Manhattan Chamber of Commerce, said that doesn't go far enough. And even though nonprofits are exempted, coalition members said some of them remain opposed because the bill would impact their subcontractors or tenants.

The Retail, Wholesale and Department Store Union has led the charge for the bill, which has 29 sponsors, five shy of the supermajority needed to override a likely veto from Mayor Michael Bloomberg, whose administration has consistently opposed wage mandates. Mr. Koppell said he would continue to listen to and address opponents' concerns.

“We should all be able to agree that taxpayers deserve the highest possible return on their investment in economic development and job creation,” he said. “This pragmatic bill stands up for the interests of all taxpayers and will actually help many businesses by strengthening the work force in fast-growing sectors like retail.”

The old adage is that markets are built on disagreement and in financial markets this is most certainly true when leverage is involved. Witness the latest "disagreement" between two mortgage lenders:

Mortgage rates are near all-time lows but for the best deal, move to British Columbia.

The province has Canada's most expensive housing but its residents are getting rockbottom rates thanks to a ferocious battle between B.C.'s credit unions and the banks.

B.C. home prices, Vancouver in particular, have long outpaced the rest of the country. The Canadian Real Estate Association said nationally home prices were up 8.9% in March from a year ago, but take out B.C. and the percentage shrinks to 4.3%.

The credit unions are another factor behind the higher prices in the province -loans from credit unions are as low as 3.64% on a five-year fixed rate closed mortgage. Canadians in other provinces, even hard negotiators, are lucky to get 4.19% from big banks...

But bond yields have dropped 30 basis points since April 11 and the banks have been slow to compensate for the situation, waiting to see if rates go back up. Mr. McLister says the banks raise rates more quickly than they lower them.

"We just have retail deposits and that's what we use for funding," says Norman Krannitz, vice-president of treasury of Coast Capital. "We looked at our deposits rates and they weren't going up so we decided to ride it out. We love the business we are getting."
